twicely Marketplace Terms of Use

These Terms of Use govern your access to and use of the twicely Marketplace platform. By accessing or using our services, you agree to be bound by these terms in their entirety. We provide a curated environment for high-end digital asset exchange, prioritizing security and intellectual property integrity.

Overview of the Platform

The twicely Marketplace is a digital venue where users can discover, purchase, and sell premium editorial assets. Our platform acts as a facilitator, providing the architectural framework for secure transactions and rights management.

Section 02

User Eligibility

Access is restricted to individuals at least 18 years of age or legally recognized business entities. Verification of identity may be required to access certain high-tier marketplace features.

03. User Accounts

Users are responsible for maintaining the confidentiality of their account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to refuse service or terminate accounts at our sole discretion.

Identity Verification

Multi-factor authentication is required for all account levels.

Section 04

Platfrom Roles

The Platform supports several categories of users
  • Buyers
  • Sellers
  • Verified Merchants
  • biz+ Merchants

Each role is subject to additional responsibilities outlined below.

05. Buyer Terms

Buyers are granted a non-exclusive, non-transferable license to use purchased assets according to the specific tier of purchase.

06. Seller Terms

Sellers warrant that all listed content is original or that they possess all necessary rights for commercial distribution.

07. Verified Merchant Terms

Merchants must undergo periodic quality audits and maintain a customer satisfaction rating above 94%.

08. biz+ Merchant Terms

Advanced analytics and white-labeling features are provided under the biz+ tier subject to separate SLA agreements.

09. Package Transfer Policy

Package transfers are permitted only within verified organizational domains. Individual license resale is strictly prohibited to maintain asset integrity and provenance tracking.

Financial Framework

10. Pricing

Dynamic pricing controls based on marketplace demand and asset rarity.

11. Payments

Funds are held in secure escrow for 14 days post-transaction for buyer protection.To detect fraud and verify the legitimacy of every transaction.

12. Redemption

Asset redemption is instant upon payment confirmation across all supported devices.

13. Fees

Platform commissions range from 5% to 15% depending on merchant verification level.

Prohibited Activities

Users shall not engage in automated scraping, reverse engineering of platform architecture, or the distribution of malicious code. We maintain zero tolerance for intellectual property theft.

Dispute Handling

Disputes are first addressed through our internal arbitration board. If unresolved, mediation must occur in the jurisdiction specified in Section 19.

Limitation of Liability

To the maximum extent permitted by law, twicely Marketplace shall not be liable for any indirect, incidental, or consequential damages resulting from platform use.

Suspension and Termination

Breach of these terms may lead to immediate suspension of services. Terminated users forfeit access to active subscription features without refund.

Amendments

We may modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.

Governing Law

These terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles. Any legal action shall be filed in the federal or state courts located in Delaware.
